Your Case Timeline & What to Expect

Every case is different, but most follow a general path. Whether it involves a private business, a large company, or the City of New York, here’s what to expect — and how we’ll guide you through each step.

1. Medical Treatment Begins
Take care of yourself first. Save all paperwork and attend appointments — it helps your case.
2. Case Investigation
We gather photos, reports, witness info, and medical records. If you have anything, send it our way.
3. Notice of Claim (City Cases Only)
For NYC, NYCHA, or MTA claims, we file a Notice of Claim within 90 days. We handle this automatically if needed.
4. Lawsuit Filed & Served
Once ready, we file your case and notify the other side. That starts the legal timeline.
5. Preliminary Conference
The court sets rules and deadlines. We handle this — you don’t need to attend.
6. Discovery
We exchange evidence, conduct depositions, and answer written questions.
7. Independent Medical Exam (IME)
If the other side sends you to a doctor, we’ll prep you and tell you exactly what to expect.
8. Settlement Talks
We push for a fair offer. You decide if it’s enough. No pressure. We’re ready either way.
9. Mediation or Arbitration
Sometimes both sides meet outside of court with a neutral person. We’ll advise if it’s right for you.
10. Trial
Most cases settle before this — but we prepare every case like it’s going to trial.
11. Resolution & Payment
We close the case, handle any liens, and issue your payment. If there's an appeal, we handle that too.

Cada caso es diferente, pero la mayoría sigue un camino general. Ya sea contra un negocio privado, una empresa grande o la Ciudad de Nueva York, aquí te explicamos qué esperar — y cómo te guiaremos paso a paso.

1. Comienza el Tratamiento Médico
Cuida tu salud primero. Guarda todos los documentos y asiste a tus citas — eso ayuda a tu caso.
2. Investigación del Caso
Reunimos fotos, informes, testigos y expedientes médicos. Si tienes algo, mándanoslo.
3. Aviso de Reclamación (Solo Casos Contra la Ciudad)
Para casos contra NYC, NYCHA o MTA, presentamos un Aviso de Reclamación en 90 días. Nosotros nos encargamos de eso si es necesario.
4. Se Presenta y Entrega la Demanda
Cuando estemos listos, presentamos tu caso y notificamos a la otra parte. Eso inicia el proceso legal.
5. Conferencia Preliminar
La corte establece fechas y reglas. Nosotros nos encargamos — tú no necesitas asistir.
6. Descubrimiento (Discovery)
Intercambiamos pruebas, tomamos declaraciones juradas y respondemos preguntas escritas.
7. Evaluación Médica Independiente (IME)
Si la otra parte te manda a un médico, te preparamos y te explicamos qué esperar.
8. Negociaciones de Acuerdo
Buscamos una oferta justa. Tú decides si es suficiente. Sin presión. Estamos listos para lo que sea.
9. Mediación o Arbitraje
A veces ambas partes se reúnen fuera de la corte con un tercero neutral. Te diremos si es lo mejor para ti.
10. Juicio
La mayoría de los casos se resuelven antes — pero nosotros preparamos cada caso como si fuera a juicio.
11. Resolución y Pago
Cerramos el caso, manejamos cualquier reclamo de terceros y emitimos tu pago. Si hay una apelación, también la manejamos.

  • Las demandas suelen tomar entre 12 y 24 meses. A veces más. Nosotros mantenemos el proceso en marcha.
  • No nos pagas a menos que ganemos.
  • Puedes escribirnos por texto o correo en cualquier momento.
  • Te mantendremos informado durante todo el proceso. Sin sorpresas.

Your Case Timeline & What to Expect

Most NYC injury cases follow a general process — whether you’re suing the City of New York, NYCHA, or a private party. Here’s what to expect from day one through resolution.

1. Medical Treatment Begins

Focus on your recovery. Attend all appointments and keep records — consistent treatment helps your case and your health.

2. Case Investigation

We gather accident reports, photos, witness info, and medical records. You’ll be updated if we need anything from you.

3. Notice of Claim (City Cases)

If your case involves NYC, MTA, or NYCHA, we must file a Notice of Claim within 90 days. We’ll handle that immediately if needed.

4. Filing the Lawsuit

Once ready, we file your summons and complaint with the court and officially serve the defendant(s).

5. Preliminary Conferences

The court sets deadlines and expectations for discovery. These are handled by our team — no need for you to attend.

6. Discovery Phase

We exchange documents, answer questions, and conduct depositions. This is when most of the legal work happens.

7. Independent Medical Exam

The defense may request you attend an IME. We’ll fully prepare you beforehand and explain what to expect.

8. Settlement Talks

We’ll negotiate aggressively. You always decide whether to accept or reject any offer — no pressure, just guidance.

9. Mediation or Arbitration

Sometimes both sides agree to resolve the case without trial. We’ll let you know if this is a good option for your case.

10. Trial

Most cases settle before trial — but if not, we’ll be ready. We prepare every case like it’s going to court from the start.

11. Resolution & Payment

We finalize your case, pay off any liens, and issue your check. If the defense appeals, we’ll walk you through the next step.

  • City claims must be filed fast — we take care of the 90-day deadline.
  • Lawsuits take time. Most cases resolve within 12–24 months, depending on the court.
