Uber and Lyft Insurance Policies
Uber and Lyft both carry extensive insurance policies designed to cover rideshare drivers, their passengers, and other parties involved in a crash—but only under specific circumstances. The coverage provided by these policies depends on the details of the accident, how it occurred, and when it happened during the rideshare process.
Insurance coverage for Uber drivers depends on app usage and is divided into three scenarios:
Offline: When the Uber driver is offline or the app is turned off, Uber does not provide any insurance coverage. In the event of an accident, the driver’s privately held auto insurance would apply.
Available: When the Uber driver is online and waiting for a ride request, Uber provides limited third-party liability insurance coverage of 50/100/25. This coverage only applies if the driver’s private auto insurance does not apply or is exhausted before damages are fully covered.
Active: When the Uber driver is en route to pick up a rider or has a passenger in the vehicle, Uber offers the highest level of coverage. This includes $1,000,000 in third-party liability insurance, uninsured/underinsured motorist (UM/UIM) bodily injury coverage, and contingent comprehensive and collision coverage (up to the car’s actual cash value with a $2,500 deductible).
Lyft’s insurance policy closely mirrors Uber’s, with only minor differences that are unlikely to affect your claim. However, if any specific aspect of Lyft’s coverage becomes relevant, we will inform you and ensure it is addressed in your case.
Are Uber and Lyft drivers employees?
No, Uber and Lyft drivers are not considered employees of these rideshare companies. They are classified as independent contractors due to extensive lobbying efforts. This classification makes it more challenging to hold the rideshare company directly liable for the actions of its drivers.
Does Uber insurance apply to Uber Eats drivers?

Does Uber deactivate a driver’s account after a crash?
